Terms of Service

These Terms of Service govern your use of the website www.primepower-fitness.com (the "Site"), operated by Prime Power Fitness. They explain what you can expect from the Site and what we expect from you. Please read them carefully.

1. Acceptance of these terms

By accessing or using the Site, you agree to these Terms of Service. If you do not agree, please do not use the Site. Purchases of products and services are also governed by our Terms of Sale, our Shipping & Freight Policy and our Returns & Refunds Policy. If there is a conflict concerning an order, those documents prevail.

2. Who we are

The Site is operated by Prime Power Fitness, a seller of commercial-grade strength equipment based at 7250 Keele St, Unit 223, Concord, Ontario L4K 1Z8, Canada. You can reach us by email at contact@primepower-fitness.com or through our contact page.

3. Eligibility

You must have reached the age of majority in your province or territory of residence to place an order or request a quote. The Site is not directed at children under 16. If you use the Site on behalf of a business or organization (for example, a gym, studio, hotel or school), you confirm that you are authorized to act on its behalf.

4. Product information and content

• Images are illustrative. Photos, renders, 3D views and videos are provided for illustration. Colours, finishes, upholstery and accessories may differ from the actual product and depend on your screen.
• Specifications come from the manufacturer. Dimensions, weights, weight stacks, maximum loads and other technical data are provided by the manufacturer and may change. If a dimension is critical for your space or installation, confirm it with us before ordering.
• Errors are corrected. We take care to keep information accurate and up to date, but errors or omissions may occur, including in descriptions, prices or availability. We correct them as soon as we become aware of them. If an error affects an order you have placed, we will contact you before proceeding, subject to your rights under applicable consumer-protection law.
• General information only. Articles and other content on the Site are general information, not medical, training or engineering advice. Consult a qualified professional before starting an exercise program or planning an installation, and always follow the manufacturer's instructions and safety warnings.

5. Prices and currency

• Prices are displayed and charged in Canadian dollars (CAD). We sell and deliver only in Canada.
• Many products are "price on request": you can obtain a price by requesting a quote on our quote page. Unless the quote states otherwise, quotes are valid for 30 days.
• Businesses can request a Pro account and volume pricing on our Pro page; Pro pricing is confirmed on quotes.
• Unless stated otherwise, prices displayed do not include taxes, freight or optional services such as installation; these are shown at checkout or on the quote.
• The price that applies to a purchase is the one confirmed in your order or in the quote you accept, as described in our Terms of Sale.

6. Accounts

You do not need an account to browse the Site, request a quote or place an order. Accounts on the Site are reserved for authorized Prime Power Fitness staff, who use them to manage the Site. You must not attempt to access administrative areas, another person's account or any non-public part of our systems.

7. Acceptable use

When using the Site, you agree not to:

• use the Site for any unlawful, fraudulent or harmful purpose;
• provide false information or impersonate another person or organization in a form, order, quote request, review or comment;
• send spam or abusive submissions through our forms;
• attempt to bypass security measures, test the vulnerability of the Site, or interfere with its operation, including by overloading it;
• introduce viruses or other malicious code;
• use robots, scrapers or other automated means to extract content or data from the Site without our written permission;
• copy or reuse Site content for commercial purposes without our written permission;
• post content that is unlawful, defamatory, hateful, misleading, infringing or that contains another person's personal information.

We may restrict, suspend or block access to the Site, or refuse a submission, if we reasonably believe these rules have been breached.

8. Reviews and comments

• What we collect. To post a product review or a blog comment, you provide your name and email address. Your name is published with your content; your email address is never published.
• Moderation. Reviews and comments are published after moderation. We may refuse or remove content that breaks these Terms, is off-topic, contains personal information or promotional links, or is not based on a genuine experience. We do not change the meaning of a review, and we publish both positive and negative reviews that comply with these rules.
• Honesty. Reviews must reflect your own genuine experience with the product. If you have a connection with us (for example, as an employee, or if you received compensation or a free product), you must say so.
• Review invitation. After delivery, we may send you one email inviting you to review your purchase.
• Licence. You keep ownership of your content. By submitting it, you grant Prime Power Fitness a non-exclusive, royalty-free, worldwide licence, for as long as the content is published, to reproduce, display, translate and adapt its format for publication on the Site and in our communications about our products, together with your name as published. You confirm that you have the right to grant this licence.
• Removal. You are responsible for your content. You can ask us to remove it at any time by contacting us.

9. Intellectual property

The Site and its content, including texts, photos, videos, 3D models, graphics, the Prime Power Fitness name and logo, the layout and the software, are owned by Prime Power Fitness or its licensors, including equipment manufacturers, and are protected by intellectual property laws. You may view and print pages for your personal use or for your organization's internal evaluation of a purchase. Any other reproduction, modification, distribution or public use requires our prior written permission. Other trademarks shown on the Site belong to their respective owners. If you believe content on the Site infringes your rights, please contact us.

10. Third-party links and services

The Site may contain links to, or embedded content from, third-party websites and services, such as the Stripe payment page, maps, videos or social networks. We do not control these third parties and are not responsible for their content, availability or practices; their own terms and privacy policies apply.

11. Newsletter

You can subscribe to our newsletter through the Site. We send it only with your express consent, which we record in accordance with Canada's Anti-Spam Legislation (CASL). Every email contains a one-click unsubscribe link, and you can withdraw your consent at any time. How we handle your subscription data is described in our Privacy Policy.

12. Availability and disclaimers

We work to keep the Site available and secure, but it is provided "as is" and "as available". We do not guarantee that the Site will be uninterrupted, error-free or free of harmful components, and we may suspend or change it, for example for maintenance. To the extent permitted by applicable law, we disclaim any implied warranties relating to the use of the Site itself. The warranties on the products we sell are set out in our Terms of Sale, and nothing in these Terms reduces the legal warranties that apply to your purchases.

13. Limitation of liability

To the extent permitted by applicable law, Prime Power Fitness is not liable for indirect, incidental or consequential damages, or for loss of data, profits or business, arising from the use of, or inability to use, the Site.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for bodily injury caused by our fault or for intentional or gross fault, or any mandatory rights you have as a consumer under the laws of your place of residence, including the Québec Consumer Protection Act and the consumer-protection laws of the other Canadian provinces. If you are a consumer in Québec, the limitations in this section do not apply to the extent that the Consumer Protection Act prohibits them.

14. Privacy and cookies

Our Privacy Policy explains how we collect and use personal information, and our Cookie Policy explains the cookies and similar technologies used on the Site. You can change your choices at any time through the "Cookie preferences" link in the footer. You can also consult our page We Do Not Sell Your Personal Information.

15. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Any dispute is submitted to the courts of Ontario. This does not deprive you of the mandatory consumer-protection rights of your place of residence, including the right, where the law grants it, to bring proceedings before the courts of your place of residence.

16. Changes to these terms

We may update these Terms to reflect changes to the Site, our services or the law. The date at the top of this page shows the latest version. Changes apply from their publication and do not affect orders placed before that date.

17. General

If a provision of these Terms is held invalid or unenforceable, the other provisions remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms are available in English and French, and both versions are intended to have the same meaning.
